CODE respects your privacy and wants you to understand what personal information we collect, why we collect it, how we use it, and the choices available to you.

This Privacy Policy applies to websites, applications, publications, events, training, subscriptions, accounts, staffing and recruiting activities, consulting inquiries, marketing communications,
and other products and services offered under the CODE brand, including CODE Magazine, CODE Consulting, CODE Staffing, CODE Training, CODE Framework, and related CODE services.

1. Who We Are

The CODE brand is operated by EPS Software Corp. and affiliated entities.

For most services offered through codemag.com, the entity responsible for determining how personal information is used is:

For certain services provided in Europe, EPS Software GmbH or another CODE-affiliated entity may be responsible for processing your information. Where another entity is responsible, we will identify that entity in the relevant form, agreement, service, or notice.

In this policy, “CODE,” “we,” “us,” and “our” refer to the applicable CODE/EPS entity responsible for the processing described.

2. Personal Information We Collect

The information we collect depends on how you interact with CODE.

We may collect identifying and contact information such as your name, email address, telephone number, company, job title, mailing address, billing address, and country or region.

We may collect account information such as your username or email address, authentication information, preferences, subscriptions, account settings, and account activity.

For CODE Magazine subscriptions and purchases, we may collect subscription selections, delivery information, billing information, transaction records, invoices, subscription history, and related fulfillment information. Payment information may be processed by CODE and/or payment-service providers depending on the transaction.

For events, webinars, conferences, classes, and training, we may collect registration details, professional information, attendance information, dietary or accessibility information that you choose to provide, event communications, and information concerning your participation. CODE events may also be photographed, streamed, or recorded. Where appropriate, additional notice will be provided at the event or during registration.

When you contact CODE regarding consulting, staffing, training, advertising, support, or another business matter, we may collect your contact details, company information, correspondence, requirements, and any information you choose to include in your message.

If you apply for employment, contractor work, or participation in CODE Staffing or CODE DevNet, we may collect your resume or CV, employment and education history, professional skills, work authorization information, compensation expectations, references, interview information, and other application materials.

We do not generally request sensitive personal information through our public website forms. However, applicants, customers, event attendees, or other individuals may voluntarily provide information that is considered sensitive or a special category of personal data in some jurisdictions. When this occurs, we process such information only when there is a legitimate need and a lawful basis to do so.

When you use our websites or applications, we may automatically collect information including IP address, browser and device information, operating system, pages viewed, referring pages, timestamps, approximate geographic information derived from IP address, cookie identifiers, advertising identifiers, and information about how you use our services.

We may also maintain professional and business relationship information, such as your company, role, professional interests, interactions with CODE, event participation, subscription history, communications, and apparent interest in CODE products or services.

If you use an AI-enabled CODE product or feature, we may process prompts, documents, code, images, messages, or other content that you submit, together with responses generated by the service.

We do NOT store credit card information of any kind.

3. Information We Receive From Other Sources

Not all information CODE maintains comes directly from you.

We may receive information from business partners, event partners, publishers, subscription partners, social-media and advertising platforms, lead-generation services, professional or business information providers, publicly available sources, company websites, professional networking sites, and other lawful sources.

For example, if you submit a CODE registration or inquiry through a third-party platform such as a social network or advertising platform, that platform may provide CODE with the information you chose to submit.

We may combine information obtained from these sources with information already maintained by CODE where permitted by law.

4. How We Use Personal Information

We use personal information to provide and administer CODE products and services; create and manage accounts; process magazine subscriptions and deliveries; process purchases and payments; register individuals for events and training; provide customer service; respond to inquiries; provide consulting, staffing, and professional services; evaluate employment and contractor candidates; protect our systems and users; diagnose technical issues; maintain records; comply with legal obligations; analyze and improve our services; measure readership and audience activity; communicate with customers and subscribers; and conduct marketing where permitted by law.

We may use information about interactions with CODE to personalize content and communications and to determine which CODE products, articles, events, training, services, or offers may be relevant to you.

We may also create aggregated or deidentified information for analytics, readership measurement, business planning, advertising measurement, research, and reporting. When information has been properly deidentified, we do not attempt to reidentify it except where permitted by law for purposes such as verifying that the deidentification process is effective.

Where European data-protection law applies, CODE relies on one or more legal bases depending on the activity.

We process information when necessary to enter into or perform a contract with you, such as providing a paid subscription, training, consulting service, or other service you requested.

We process information when necessary for legitimate business interests, such as operating and securing our services, responding to business inquiries, maintaining customer and professional relationships, improving our products, preventing fraud, maintaining business records, and conducting appropriate business-to-business activities, provided those interests are not overridden by your rights and interests.

We rely on consent where required, including for certain marketing communications, non-essential cookies and similar technologies, and certain other processing activities.

We also process information where necessary to comply with legal obligations or establish, exercise, or defend legal claims.

Where we rely on consent, you may withdraw that consent at any time. Withdrawal does not affect processing that was lawful before the withdrawal.

6. Magazine Subscriptions and Mailing Addresses

CODE Magazine collects information required to establish, administer, qualify, and fulfill subscriptions.

For print subscriptions, this includes a delivery address.

For digital subscriptions, CODE may request geographic or address information where it is reasonably necessary for subscription administration, eligibility, circulation or audience measurement, fraud prevention, offer qualification, legal compliance, or another purpose disclosed when the information is collected.

7. Marketing Communications

CODE sends newsletters, event announcements, product information, and other marketing communications in accordance with applicable law.

Where consent is required, CODE will obtain the required consent before sending marketing communications.

You may unsubscribe from marketing emails at any time by using the unsubscribe mechanism included in the message or by changing available communication preferences in your CODE account.

CODE may continue to send non-marketing communications that are necessary for a service you requested, such as invoices, security notices, subscription notices, registration confirmations, service announcements, and other transactional or administrative communications.

If CODE sends a marketing communication that promotes a business partner or sponsor, this does not by itself mean that CODE has provided your contact information to that partner. We provide personal information to partners for their own marketing only when permitted by law and consistent with the disclosures or choices presented to you.

Marketing by SMS, telephone, or similar electronic communications is conducted only where permitted by applicable law and subject to any consent requirements that apply.

8. Cookies, Analytics, and Advertising

CODE uses cookies and similar technologies for purposes such as authentication, security, preferences, site functionality, analytics, social-media functionality, advertising, and measuring the effectiveness of our services and communications.

Where required by law, non-essential cookies and similar technologies are used only after obtaining the required consent.

You may manage available cookie choices through our cookie-preference controls.

CODE may work with analytics, advertising, social-media, and technology providers that receive online identifiers or information about interactions with our services. Under some U.S. state privacy laws, certain advertising-related disclosures may be considered a “sale,” “sharing,” or processing for “targeted advertising,” even when CODE does not provide the recipient with your name or email address.

Where applicable law provides a right to opt out of such processing, CODE provides an appropriate opt-out mechanism and recognizes applicable browser-based universal opt-out signals, including Global Privacy Control, where legally required.

9. When We Share Information

We may disclose personal information to service providers and contractors that perform services for CODE, including hosting, cloud infrastructure, email delivery, magazine fulfillment, postal delivery, payment processing, security, customer support, analytics, event services, advertising technology, communications, and other operational services.

We may disclose information to business or event partners where you have requested the disclosure, consented to it, or were informed at the time of collection that the information would be shared.

We may disclose information between CODE/EPS affiliated entities where reasonably necessary to operate our business and provide services.

We may disclose information when reasonably necessary to comply with applicable law, court orders, subpoenas, legal proceedings, or lawful government requests; to protect the rights, security, and property of CODE or others; to investigate suspected fraud or misuse; or to establish, exercise, or defend legal claims.

Information may also be transferred as part of a merger, acquisition, financing, restructuring, sale of assets, or similar corporate transaction, subject to appropriate safeguards.

CODE does not sell lists of personal information for money.

However, as described above, some advertising or analytics disclosures may fall within broader statutory definitions of “sale” or “sharing” under certain U.S. privacy laws. Where those laws apply, you may exercise the applicable opt-out rights.

10. Customer and Client Data

CODE frequently provides software development, consulting, staffing, hosting, AI, and other professional services to businesses.

When CODE processes personal information on behalf of a customer and according to that customer's instructions, CODE acts as a service provider or data processor rather than deciding independently how the information will be used.

In those circumstances, the customer's privacy notice and CODE's agreement with that customer govern the processing. Individuals seeking to exercise rights regarding information controlled by a CODE customer should ordinarily contact that customer directly.

CODE enters into appropriate data-processing agreements where required by applicable law.

11. AI-Enabled Services

Some CODE products or professional services may use artificial intelligence, machine learning, large language models, or other automated technologies.

Information you submit to these services may be processed by CODE systems and, where necessary, by cloud, AI-model, or technology providers acting on CODE's behalf.

CODE uses reasonable contractual and technical safeguards appropriate to the service and the nature of the information processed.

CODE does not use confidential customer content submitted through paid professional services to train general-purpose AI models unless the customer has expressly agreed to such use.

Where an AI-enabled feature involves materially different privacy practices, CODE may provide an additional service-specific privacy notice.

12. Recruiting and Staffing

Information submitted in connection with employment, contractor opportunities, CODE Staffing, or CODE DevNet may be used to evaluate qualifications, communicate with candidates, verify information, consider candidates for current or future opportunities, comply with employment and legal requirements, and administer recruiting and staffing activities.

Candidate information may be shared with CODE personnel and, where appropriate and legally permitted, with customers considering the candidate for an opportunity.

We may maintain candidate information for future opportunities for a reasonable period consistent with applicable law. Where consent is required for extended retention, we will obtain it.

CODE may provide a separate Applicant Privacy Notice containing additional details for applicants in jurisdictions where this is appropriate or required.

13. International Data Transfers

CODE operates internationally. Personal information may therefore be processed in the United States, the European Economic Area, and other countries where CODE, its affiliates, customers, or service providers operate.

When European personal information is transferred to a country that does not provide an equivalent level of legal protection, CODE uses legally recognized safeguards where required, such as the European Commission's Standard Contractual Clauses or another valid transfer mechanism.

You may contact us for additional information about applicable transfer safeguards.

14. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this policy, including providing services, maintaining subscriptions and accounts, maintaining appropriate business and transaction records, complying with legal, tax, accounting, and regulatory requirements, resolving disputes, enforcing agreements, preventing fraud, maintaining security, and establishing or defending legal claims.

Retention periods vary depending on the type of information, the relationship involved, applicable legal requirements, and whether continued retention is reasonably necessary.

Where practical, CODE deletes or deidentifies information when it is no longer required.

15. Security

CODE maintains administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure.

Access to personal information is limited to employees, contractors, and service providers that reasonably require access for legitimate business purposes.

No information system can guarantee absolute security. If you believe your CODE account or information may have been compromised, contact us promptly.

16. Your Privacy Rights

Depending on where you live and the law that applies, you may have rights regarding your personal information.

These rights may include requesting access to personal information we hold about you; correcting inaccurate information; requesting deletion; requesting restriction of certain processing; receiving certain information in a portable format; objecting to processing based on legitimate interests or for direct marketing; withdrawing consent; opting out of sale, sharing, targeted advertising, or certain profiling; limiting certain uses of sensitive information; and appealing a decision concerning a privacy request where applicable.

We will not unlawfully discriminate against you because you exercised a privacy right.

We may need to verify your identity before completing certain requests. Authorized agents may submit requests where permitted by applicable law, subject to appropriate verification.

Where applicable, we also honor qualifying universal opt-out signals such as Global Privacy Control.

Residents of the European Economic Area also have the right to lodge a complaint with the data-protection supervisory authority responsible for their location, workplace, or the location of the alleged infringement.

17. Direct Marketing Rights in Europe

If European data-protection law applies, you have the right to object at any time to the processing of your personal information for direct-marketing purposes, including associated profiling.

When you object to such processing, CODE will stop using the relevant information for direct marketing as required by applicable law.

18. Children

CODE's services are principally intended for professionals and other adult users and are not directed to children under 13.

We do not knowingly collect personal information from children under 13 in circumstances requiring parental consent. We do not knowingly sell or share personal information of individuals under 16 for targeted advertising where applicable law requires affirmative authorization.

If you believe a child has provided personal information to CODE improperly, please contact us.

19. Third-Party Websites and Services

CODE websites and communications may contain links to websites, applications, social networks, or services operated by other organizations.

Their privacy practices are governed by their own policies. CODE is not responsible for privacy practices of services we do not control.

20. Changes to This Policy

We may update this Privacy Policy as our services, technologies, and legal obligations change.

When we make material changes, we will provide notice appropriate to the nature of the change, which may include posting a prominent notice on our website or sending notice to affected account holders.

The effective date and last-updated date at the beginning of this policy indicate the most recent revision.
